
How the Scheme Works
Premium
We will waive the premium due if the claim is unsuccessful.
Delegated Authority
It is important for solicitor firms to be able to make their own decisions on the sorts of cases which they feel they can successfully pursue on a CFA basis. We offer delegated authority to all solicitor firms to issue policies on standard CFA cases provided the solicitor firm satisfies our panel criteria.
Delegated Authority is not available for the following types of cases:
- All Multi -Track cases
- Multi Party or Multi Defendant cases
- Industrial Disease - including Repetitive Strain Injury, Asbestosis, Vibration White Finger etc. (anything that is "gradually operating" and not an accident).
- Post issue cases
- Where the case is over 2 years old, at the time the policy is to be issued
Cases which fall outside of the delegated authority scheme must be referred to us individually and may be subject to an enhanced premium. Any quotation is valid for 3 months.
Administration of the Scheme
The scheme is administered via our CFA Link internet site. This secure website is a 'real-time' system that allows our firms to;
- Add case details
- Update cases and inform us of cases wins
- Request claims payments
- View reports on outstanding cases
- Order stationary
Guidelines and training to use the CFA Link system are provided by ALP.
Case Status
You must regularly update cases on the CFA Link internet site.
Barristers
Own barristers fees are not covered under the policy.
All barristers used will be on a CFA.
Terms of Business Agreement
Solicitor firms have to sign a Terms of Business Agreement (TOBA). This will govern the operation of the scheme, and their contractual relationship with us.
